Terms of Service - Fresh Tracks Canada
Effective Date: October 14, 2026
1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website located at xintrumtrar.site and any related services, content, features, bookings, communications, and offerings provided by Fresh Tracks Canada ("Fresh Tracks Canada," "we," "us," or "our").
By accessing or using our website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any additional terms or policies referenced herein, including our privacy practices. If you do not agree to these Terms, you must not use our website or services.
These Terms are intended to be interpreted in accordance with applicable laws in Canada, including applicable federal and provincial consumer protection, privacy, e-commerce, and travel-related laws.
2. Scope of Services
Fresh Tracks Canada provides travel-related services, which may include, without limitation:
- Travel planning and coordination;
- Assistance with booking transportation, accommodations, activities, and related travel arrangements;
- Providing travel information, itineraries, and customer support;
- Facilitating communication with third-party travel providers, suppliers, or affiliates.
Unless expressly stated otherwise, Fresh Tracks Canada acts as an intermediary and not as the direct provider of third-party services such as airline transport, hotel accommodations, tour operations, car rentals, or insurance products. Those services may be subject to the terms and conditions of the applicable third-party provider.
We reserve the right to modify, suspend, or discontinue any service, feature, or content at any time, subject to applicable law and any existing contractual commitments.
3. User Obligations and Responsibilities
By using our services, you agree that you will:
- Provide accurate, complete, and current information at all times, including names, contact details, travel documents, and payment information;
- Review all booking details carefully before confirming any reservation or purchase;
- Ensure that all travelers have valid passports, visas, permits, vaccinations, and other documentation required for travel;
- Comply with all applicable laws, regulations, airline rules, hotel policies, border requirements, and destination entry rules;
- Not use the website for unlawful, fraudulent, harmful, or unauthorized purposes;
- Promptly notify us of any errors, discrepancies, or changes affecting your booking or travel arrangements;
- Maintain the confidentiality of any account credentials, if applicable, and accept responsibility for activities conducted through your account.
You are solely responsible for determining whether travel is appropriate for you and any accompanying travelers, including with respect to health, safety, weather, political, and security conditions.
4. Payment Terms and Conditions
All prices are displayed in Canadian dollars unless otherwise stated. Prices, availability, taxes, fees, surcharges, and other charges may change without notice until a booking is confirmed. Additional fees imposed by third parties, including airlines, hotels, or government authorities, may apply.
By submitting payment information, you authorize Fresh Tracks Canada or its payment processors to charge the applicable amounts for services selected by you. You represent and warrant that you are authorized to use the payment method provided.
Unless otherwise specified:
- A deposit, full prepayment, or partial payment may be required to confirm a booking;
- Outstanding balances must be paid by the deadlines communicated to you;
- Failure to make timely payment may result in cancellation of the booking, loss of deposits, or other applicable penalties;
- Chargebacks or payment disputes initiated without valid grounds may result in suspension of services and recovery of related costs, to the extent permitted by law.
We are not responsible for additional charges imposed by your financial institution, including foreign transaction fees, exchange rate differences, or payment processing charges.
5. Cancellation and Refund Policy
Because travel services often involve third-party suppliers with their own restrictions, cancellations and refunds are subject to both these Terms and the applicable supplier terms.
Unless a different policy is stated at the time of booking:
- Cancellation requests must be submitted in writing to Fresh Tracks Canada;
- Refund eligibility, if any, depends on the rules of the relevant supplier, the timing of the cancellation, and any non-refundable service fees already incurred;
- Service fees, processing fees, consultation fees, and certain deposits may be non-refundable to the extent permitted by law;
- Changes to reservations may be treated as cancellations and rebookings by the supplier and may involve additional fees;
- No refund will be owed for unused travel services, missed departures, no-shows, voluntary cancellations, or failure to present required travel documents, unless required by law or supplier policy.
If a refund is approved, processing times may vary depending on the payment method, financial institution, and third-party supplier timelines. Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection legislation in Canada.
6. Liability Limitations
To the fullest extent permitted by applicable law, Fresh Tracks Canada shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of enjoyment, loss of opportunity, or loss of data, arising from or related to your use of the website or services.
Without limiting the foregoing, we are not responsible for:
- Acts, omissions, delays, cancellations, overbookings, insolvency, or failures of third-party travel suppliers;
- Travel disruptions caused by weather, natural disasters, labor disputes, public health events, border restrictions, government actions, civil unrest, or security incidents;
- Errors arising from inaccurate information supplied by you or a third party;
- Losses resulting from your failure to obtain proper documentation or comply with applicable travel requirements.
To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the services shall not exceed the amount paid by you to Fresh Tracks Canada for the specific service giving rise to the claim during the three-month period preceding the event giving rise to the claim, or the minimum amount required by applicable law, whichever is greater.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct, or gross negligence where such limitation is not permitted.
7. Intellectual Property Rights
All content on the website, including text, graphics, logos, icons, images, design, layout, software, and trademarks, is owned by or licensed to Fresh Tracks Canada and is protected by applicable intellectual property laws in Canada and internationally.

We may collect personal information such as your name, contact details, travel preferences, payment information, passport or identification details, and other information necessary to arrange travel services, communicate with you, process payments, and comply with legal obligations.
We may share personal information with third-party service providers, suppliers, payment processors, and other entities as reasonably necessary to fulfil bookings, provide customer support, comply with legal requirements, and protect our rights and interests.

By using our services, you consent to the collection, use, disclosure, and transfer of your personal information as described in these Terms and any applicable privacy policy. You are responsible for providing consent on behalf of any traveler whose information you submit.
9. Force Majeure
Fresh Tracks Canada shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, epidemic, war, terrorism, riots, strikes, labor disputes, government orders, sanctions, transportation interruptions, utility failures, cyber incidents, or failures of third parties.
In such circumstances, our obligations shall be suspended for the duration of the event and for a reasonable period thereafter. We will use commercially reasonable efforts to resume performance and to communicate with affected customers when practicable.
10. Changes to Terms

These Terms, and any dispute arising out of or relating to them or the services, shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in Vancouver, British Columbia, Canada shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or relating to these Terms or the services, subject to any mandatory consumer protection laws that provide otherwise.

To the extent permitted by law, any invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the original intent and economic effect of the original provision.
